Update:

The only approvals for the proposed landfill  have been the Regional BIA approval of the completion of the Environmental Impact Statement in January 2000 and a 'conditional' lease approval in January 2007.  The conditions within the lease are set forth by the Record of Decision.

Colusa County will require an Environmental Impact Report  to be paid for by the landfill developers which is needed to comply with California Enviromental Quality Act-

  • CEQA for County Roads and California Highways

 

 Additional Requirements to Fulfill Conditions set by Law for Permit to Operate Landfill  as of December 2008 (identified at this time):

 

  • EPA Stormwater Permit

 

  • Army Corp of Engineers Clean Water Section 404 Permit

 

  • Pollutant Discharge Permit

 

  • Water Quality Certification

 

  • Clean Air Act - Title V Operating Permit and USEPA Review and Approval of Asbestos Monofill Removal Plan (illegally dumped in 1988 and still not contained)

 

  • Consultation regarding impacts to species or habitat protected under the Endangered Species Act

 

  • Agreement with local Fire Department(s) or developers need to provide equivalent Fire Protection

 

  • Off-site roadway improvements expressed in the ROD

 

  • Agreements with Colusa County mitigation measures

 

  • Permits issued by Colusa County and Cal-Trans for Roadways
